Counter-Notification
If you believe that your content that was removed or to which access was disabled is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or pursuant to law, to post and use the material, you may send a counter-notification containing the following information to our Copyright Agent:
- Your physical or electronic signature
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
- A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the courts in the location where you reside, or if outside the United Kingdom, for any judicial district in which xalvanta may be found
- A statement that you will accept service of process from the person who provided notification of the alleged infringement
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and services or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Processing Timeline
Upon receipt of a valid DMCA notice, we will:
- Acknowledge receipt of your notification within two business days
- Review the submitted information for completeness and validity
- Remove or disable access to the allegedly infringing material expeditiously if the notification meets all requirements
- Notify the user who posted the material of the removal or access restriction
- Provide the user with information regarding counter-notification procedures
If we receive a valid counter-notification, we will forward it to the original complainant and inform them that we may restore the removed content or cease disabling access to it within 10 to 14 business days unless we receive notice that a legal action has been filed seeking a court order to restrain the user from engaging in infringing activity.
False Claims
Please be aware that under the DMCA, any person who knowingly materially misrepresents:
- That material or activity is infringing, or
- That material or activity was removed or disabled by mistake or misidentification
may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner or its authorized licensee, or the service provider.
